1. Acceptance of Terms
By accessing or using AmrioxClinic ("the Platform", "the Service", "we", "us"), you ("the Clinic", "the User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.
These Terms form a legally binding agreement between you and AmrioxClinic, owned and operated by Ameer Hamza, based in Pakistan. Use of the Platform by any individual or entity constitutes acceptance of these Terms in their entirety.
2. Description of Service
AmrioxClinic is a Software as a Service (SaaS) clinic management platform that provides the following core features:
- Online appointment booking and management
- Patient records and contact management
- Multi-staff scheduling and role-based access
- Automated WhatsApp notifications via the Meta Business API
- Booking calendar and reporting tools
- Public-facing clinic profile pages
The features available to your account depend on the subscription plan you have selected. AmrioxClinic reserves the right to add, modify, or remove features at any time with reasonable notice.
3. Eligibility
The Platform is intended for use by registered healthcare facilities, independent practitioners, clinics, and their administrative staff operating lawfully in Pakistan. By using the Service, you represent that:
- You are at least 18 years of age
- You have the legal authority to enter into this agreement on behalf of your clinic or organisation
- Your use of the Platform does not violate any applicable law in Pakistan
- All information you provide is accurate and up to date
4. Account Registration & Responsibilities
You must register an account to access the clinic dashboard. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access to your account
- Take full responsibility for all activities that occur under your account
You must not share your account credentials with individuals outside your clinic. Each staff member should have their own login. AmrioxClinic will not be liable for any loss resulting from unauthorised account access due to your failure to safeguard your credentials.
5. Subscription & Payment
5.1 Plans & Billing
AmrioxClinic offers monthly subscription plans. All prices are listed in Pakistani Rupees (PKR) and are subject to change with at least 30 days' notice. A one-time setup fee may apply to new subscriptions.
5.2 Payment Methods
We currently accept EasyPaisa, JazzCash, and direct bank transfer. Payment must be made in full at the start of each billing period. Failure to pay within the grace period (7 days) may result in account suspension.
5.3 Refunds
Monthly subscription fees are non-refundable once the billing period has begun. Setup fees are non-refundable after onboarding has been initiated. If you believe a payment error has occurred, contact us within 7 days at our contact page.
5.4 Plan Limits
Each plan includes specific limits on bookings, staff accounts, WhatsApp messages, and services. Exceeding these limits may result in a notification to upgrade your plan. AmrioxClinic will not delete or alter existing data if you exceed limits; however, new bookings may be restricted.
5.5 Cancellation
You may cancel your subscription at any time by contacting us. Your access will continue until the end of the current paid billing period. We do not offer prorated refunds for early cancellation.
6. Acceptable Use Policy
You agree not to use the Platform to:
- Violate any applicable Pakistani law or regulation
- Upload false, misleading, or harmful patient data
- Send unsolicited or spam WhatsApp messages to patients who have not consented to receive them
- Attempt to reverse-engineer, decompile, or copy any part of the Platform
- Interfere with or disrupt the Platform's infrastructure or other users
- Use automated bots or scripts to scrape or overload the Platform
- Resell or sublicense access to the Platform to third parties without written consent
- Upload any malware, ransomware, or malicious code
Violation of this policy may result in immediate account suspension and, where applicable, referral to relevant authorities.
7. Patient Data & Privacy
As a clinic using AmrioxClinic, you are the data controller for the patient information you enter into the Platform. AmrioxClinic acts as a data processor on your behalf. You are solely responsible for:
- Obtaining patient consent before entering their personal data into the Platform
- Complying with all applicable data protection obligations under Pakistani law
- Ensuring patient data is accurate and up to date
- Managing patient data access requests and deletion requests from your patients
AmrioxClinic will never sell, rent, or share patient data with any third party, except as required by law or to operate the Platform (e.g., WhatsApp API delivery). For full details, refer to our Privacy Policy.
8. WhatsApp Integration
AmrioxClinic integrates with the official Meta WhatsApp Business API to send transactional messages. By enabling WhatsApp features, you agree to:
- Only send messages to patients who have provided their phone number voluntarily for appointment purposes
- Comply with Meta's WhatsApp Business Policy
- Not use the WhatsApp blast feature for unsolicited marketing messages
- Accept that message delivery is subject to Meta's infrastructure and is not guaranteed
AmrioxClinic is not liable for message delivery failures, delays, or WhatsApp account restrictions imposed by Meta.
9. Intellectual Property
All software, design, branding, code, and content on the AmrioxClinic Platform is the exclusive intellectual property of AmrioxClinic (Ameer Hamza). You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for the purpose of managing your clinic operations.
You retain ownership of your clinic data (patient records, booking data, staff information). Upon termination, you may request an export of your data within 30 days. After that period, your data may be permanently deleted.
10. Service Availability & Uptime
AmrioxClinic aims to maintain high availability but does not guarantee uninterrupted service. The Platform may be temporarily unavailable due to:
- Scheduled maintenance (communicated in advance where possible)
- Third-party service failures (hosting, WhatsApp API, email providers)
- Force majeure events beyond our control
We will make reasonable efforts to notify you of planned downtime in advance. We do not offer SLA credits for unplanned downtime.
11. Limitation of Liability
To the maximum extent permitted by applicable law, AmrioxClinic shall not be liable for:
- Loss of revenue, profit, or business opportunity resulting from Platform downtime or feature changes
- Missed appointments or no-shows not prevented by the system
- Unauthorised access to your account resulting from your failure to secure credentials
- WhatsApp message delivery failures or delays
- Data loss due to circumstances beyond our control
In no event shall AmrioxClinic's total liability to you exceed the amount paid by you to AmrioxClinic in the three (3) months preceding the event giving rise to the claim.
12. Termination
AmrioxClinic reserves the right to suspend or terminate your account immediately and without prior notice if:
- You violate any provision of these Terms
- You fail to pay subscription fees after the grace period
- We are required to do so by law or regulatory authority
- Continued provision of the Service poses a risk to other users or the Platform
You may terminate your account at any time by contacting us. Upon termination, your access will be revoked. Data export requests must be made within 30 days of termination.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.
14. Changes to These Terms
AmrioxClinic may update these Terms from time to time. If changes are material, we will notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
